A Patna District and Sessions court has stepped in to grant dynamic legal relief to popular educator and YouTuber Faizal Khan, widely known as Khan Sir. The court has issued an interim stay on his arrest following an anticipatory bail plea filed by his legal team.
While the court cleared the path for Patna Police investigators to continue their questioning, it explicitly restricted any coercive actions—including immediate arrest—while the case continues. The court has called for an updated case diary and the educator’s background history from Kadamkuan police station, scheduling the next formal hearing for later this month.
Anatomy of the Altercation: The Musallahpur Haat Clash
The legal dispute traces back to a violent altercation that erupted on the night of June 2 outside the Khan Global Studies (KGS) institute in Patna’s high-density coaching hub, Musallahpur Haat:
-
The Vandalism Catalyst: A hostile mob of 15–20 individuals allegedly linked to a local competitor, the Gyan Bindu Coaching Institute, targeted the KGS premises. The group pelted stones, tore down institutional signboards, and severely assaulted a KGS security guard.
-
The Supposed Origin: Investigators point out that the clash stems from a fierce commercial rivalry over claims regarding successful selections in the recently declared Bihar Police constable recruitment examinations.
-
The Retaliatory Gunfire: As the situation escalated, two KGS security guards fired rounds into the air using licensed .315-bore rifles to disperse the mob. Digital videos capturing the gunshots quickly went viral across social media.
The Core Legal Conflict: Conflicting Testimonies
The legal vulnerability for Khan Sir emerged after Patna Police detained and interrogated the two coaching institute security guards:
The Security Guards’ Account: During custodial questioning, the guards asserted that they did not act independently. They claimed they opened fire in the air directly on the verbal instructions of Khan Sir, who they alleged was physically present at the venue when the vandalism reached its peak.
Based on these statements, authorities expanded the scope of the counter-case, naming Khan Sir in a First Information Report (FIR) under severe provisions of the law, including attempt to murder and violations of the Arms Act.
Conversely, Khan Sir’s defense counsel, Advocate Arvind Kumar Mouar, strongly rejected these accusations in court. He argued that the educator’s name was maliciously injected into the FIR as part of a targeted conspiracy by a business competitor to intentionally damage his public reputation. The defense maintains that the security guards acted strictly in self-defense to safeguard the institute’s staff and students during an active riot.
The Immediate Outlook: Under the current judicial shield, Khan Sir is legally permitted to travel and manage his operations. However, he is required to fully cooperate with local investigators as Patna Police cross-examine institutional records and forensic evidence ahead of the upcoming court date.
