The Supreme Court of India has issued formal notices to 20 rebel Trinamool Congress (TMC) Lok Sabha MPs who defected from the party and merged with the National Citizens Party of India (NCPI) to align with the NDA.
The plea was filed by TMC General Secretary and Lok Sabha leader Abhishek Banerjee, seeking a direction for the Lok Sabha Speaker to decide the pending disqualification petitions in a time-bound manner under the Tenth Schedule (Anti-Defection Law).
Key Highlights of the Proceedings
-
Notices Issued to Rebel MPs:
-
A bench led by Chief Justice Surya Kant, alongside Justice Joymalya Bagchi and Justice Vipul M. Pancholi, issued notices to all 20 defecting MPs.
-
-
Why No Notice Was Issued to the Lok Sabha Speaker:
-
The court initially indicated it would issue a notice to Speaker Om Birla as well.
-
However, Solicitor General Tushar Mehta, appearing for the Speaker, requested the court not to issue a formal notice, confirming that he had instructions to represent the Speaker’s office and that disqualification notices had already been issued internally.
-
-
Focus on Time-Bound Conclusion:
-
Responding to the SG’s statement that notices had been issued by the Speaker, Justice Joymalya Bagchi clarified: “It is not a question of issuing notices; it is a question of concluding the proceedings within a time frame.”
-
-
Core Legal Dispute:
-
TMC’s Position: The party argues that the MPs elected on the TMC symbol voluntarily gave up membership by joining another political group and aligning with the NDA, attracting immediate disqualification under the Tenth Schedule.
-
Rebel Camp’s Stand: The 20 MPs claim their move constitutes a valid party merger under anti-defection provisions.
